Follio Inc. ("Follio", "we", or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy (“Policy”). This Policy describes the types of information we may collect from you or that you may provide when you access or use our website located at follio.co ("Website") or our Follio app and/or software (“App”), and our practices for collecting, using, maintaining, protecting, and disclosing that information. This Policy applies to information we collect:

• On or through the Website or App;

• In emails, texts, or other electronic messages between you and the Website or App; and

• Through mobile or desktop applications you download from the Website, which provide dedicated non-browser-based interaction between you and the Website.

It does not apply to information collected by:

· Us offline or through any other means; or

· Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Website or App.

Please read this Policy carefully to understand our practices regarding your information. If you do not agree with this Policy, do not access, visit, or use the Website or App. By visiting, accessing, or using the Website or App, you agree to this Policy. This Policy may change from time to time (see “Changes to Our Privacy Policy” below). Children Under the Age of 18

The Website and App are not intended for children under 18 years of age. No one under age 18 may provide any information, personal or otherwise, to the Website or App. We do not knowingly collect personal information from children under 18. If you are under 18, do not access, use, or provide any information on the Website or through the App. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Website and App, including information:

· By which you may be personally identified, including without limitation name, postal address, email address, telephone number, company name, job title or position, financial information such as credit or debit card numbers or checking account numbers, and any other identifier by which you may be identified or contacted online or offline ("Personal Information");

· That is about you but individually does not identify you, such as gender, personal preferences or interests, or location information; and/or

· About your internet connection, the equipment you use to access our Website or App, and other usage details.

We collect this information:

· Directly from you when you provide it to us.

· Automatically as you navigate through the Website or App. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, or other tracking technologies.

· From third parties, including without limitation, designers or third-party vendors that you purchase products or services from through the App or which also access or use the App.

o Information You Provide to Us  

The information we collect on or through our Website or App may include:

· Information that you provide to us by filling in forms on the Website. This includes information provided if you register to use the Website or book a demo. You can access and use the Website without providing any such information; however, certain portions or functions of the Website may then be inaccessible or unusable for you.

· Information that you provide to us by posting material on the App, uploading material to the App, communicating with us or third parties via the App (collectively, “User Contributions”), or requesting or ordering products or services through the App.

· Records and copies of your correspondence, including emails, if you contact us.

· Details of transactions you carry out through our Website or App, and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website or App.

· Your search queries on the Website.

Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to your folders and pages within the App and you may also set certain privacy settings for such information, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third party vendors on the App with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

o Information We Collect Through Automatic Data Collection Technologies  

As you navigate through and interact with the Website or App, we may use automatic data collection technologies, including, without limitation, Google Analytics, Google Search Console, Hotjar, Facebook Pixel, Google Ads, and Facebook and Instagram Ads, to collect certain information about your equipment, browsing actions, and patterns, including:

· Details of your visits to the Website or use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website or App.

· Information about your computer and internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). The information we collect automatically does not include Personal Information, but we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Website and App and to deliver better and more personalized services, including by enabling us to:

· Estimate our audience size and usage patterns.

· Store information about your preferences, allowing us to customize the Website and App according to your individual interests.

· Speed up your searches.

· Recognize you when you return to our Website.

The technologies we use for this automatic data collection may include:

As mentioned, we do not collect Personal Information automatically, but we may tie non-personal information collected automatically to Personal Information about you that we collect from other sources or that you provide to us.

Third-Party Use of Cookies and Other Tracking Technologies

Some content on the Website or App may be served by third-parties, including payment providers (including, without limitation, Stripe) content providers, application providers, and product and service providers. These third parties may use cookies [alone or in conjunction with web beacons or other tracking technologies] to collect information about you when you use the Website or App. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. How We Use Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose Personal Information that we collect or that you provide as described in this Privacy Policy:

· To our subsidiaries and affiliates.

· To contractors, service providers, and other third parties we use to support our business or your activities on the App.

· To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Follio’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Follio about our Website and App users is among the assets transferred.

· To fulfill the purpose for which you provide it.

· For any other purpose disclosed by us when you provide the information.

· With your consent.

We may also disclose your Personal Information:

· To comply with any court order, law, or legal process, including to respond to any subpoena or government or regulatory request.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

· Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Website or App may then be inaccessible or not function properly.

· Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by adjusting your user preferences in your account profile at the Website or App, or by sending us an email with your request to [EMAIL ADDRESS].

· Promotional Offers from the Company. If you do not wish to have your email address or contact information used by Follio to promote our own or third parties' products or services, you can opt-out by adjusting your user preferences in your account profile at the Website or App, or by sending us an email stating your request to [EMAIL ADDRESS]. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, product or service experience,  or other transaction.

· Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by adjusting your user preferences in your account profile at the Website or App, or by sending us an email with your request to hello@follio.co.

We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. Residents of certain states, such as California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia may have additional Personal Information rights and choices. Accessing and Correcting Your Information

You can review and change your Personal Information by logging onto the Website and/or the App and visiting your account profile page. You may also send us an email at hello@follio.co to request access to, correction of, or deletion of any Personal Information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the App, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other App users. Proper access and use of information provided on the App, including User Contributions, is governed by the App Terms of Use.

Residents of certain states, such as California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia may have additional Personal Information rights and choices. Please see “Your State Privacy Rights, below, for more information.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information.

California state consumer privacy laws provide California residents with the following additional rights:

· Right to Know. You have the right to receive notice at or before the point of collection about our collection and retention practices.

· Right of Access. You have the right to access your Personal Information maintained by us. Upon receipt of a verifiable request, sent to hello@follio.co, to access Personal Information, we will disclose and deliver the Personal Information requested free of charge.

· Right of Deletion. You have the right to request that we delete any Personal Information about you that we have collected from you. Upon receipt of a verifiable request for deletion, we will delete your Personal Information from our records within 45 days. Please note, we will comply with your request to delete Personal Information unless it is necessary for us to maintain such Personal Information in order to:

 Complete a transaction, provide requested-for goods/services, and/or perform a contract between you and us;

 Detect security incidents;

 Comply with a legal obligation;

 Enable our internal uses that are aligned with your expectations and your relationship with us and are compatible with the context in which you provided the information.

· Right to Correct. You have the right to request that we correct inaccurate Personal Information that we maintain about you. You can review and change your Personal Information by logging into the Website or App visiting your account profile page.

· Right to Opt-Out of Sale or Sharing. Certain data collection on our Website or App by third parties for purposes of interest-based advertising and social media tools may be a “sale” or “sharing” under California privacy law. As defined by California law, we “sold” or “shared” certain data elements within the following categories of Personal Information: identifiers, Internet or other electronic network activity information, approximate geolocation, and inferences drawn from the information identified here. We “sold” or “shared” each category to or with affiliated companies, third parties, and service providers who provide advertising, marketing, or audience measurement; and with social networks at your direction. The business or commercial purposes of “selling” or “sharing” the information is to assist us with advertising, marketing, audience measurement, and other functionality on our Website or App. You may exercise your right to opt-out of the sale or sharing of Personal Information by sending an email to hello@follio.co.

· Right to Limit Use or Disclosure of Sensitive Personal Information. We do not gather sensitive Personal Information.

· Children. As noted above, we do not knowingly collect information from or about children under age 18 and we do not sell or share information of minors under age 18.

· No Discrimination. We will not discriminate against a California resident because the California resident exercised any of the rights described here. Specifically, we will not:

• Deny you goods or services.

• Charge you different prices or rates for goods or services, including through granting discounts or other benefits or imposing penalties.

• Provide you a different level or quality of goods or services.

• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

• Discriminate in making employment decisions.

• California’s “Shine The Light” law permits California residents to annually request and obtain information free of charge about what Personal Information is disclosed to third parties for their direct marketing purposes in the preceding calendar year.  If you are a California resident and would to request this information, please submit a written request to the following email address: hello@follio.co. Please allow 30 days for a response.

California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia also provide their state residents with rights to:

· Confirm whether we process their personal information.

· Access and delete certain personal information.

· Correct inaccuracies in their personal information, taking into account the information's nature processing purpose (excluding Iowa and Utah).

· Data portability.

· Opt-out of personal data processing for:

o targeted advertising (excluding Iowa);

o sales; or

o profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).

· Either limit (opt-out of) or require consent to process sensitive personal data.

The exact scope of these rights may vary by state. To exercise any of these rights please send an email to hello@follio.co.  Nevada provides its residents with a limited right to opt-out of certain personal information sales. Please note that we do not currently sell data triggering that statute's opt-out requirements.

Data Security

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website or App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Website or App. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website or App.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our Privacy Policy on this page, with a notice that the Privacy Policy has been updated on the Website home page. The date the Privacy Policy was last revised is identified at the top of the page.
